Civil sanctions


Regulation 6 of the Energy Information Regulations 2011 SI No. 1524 provides the appointed market surveillance authority (NMO) with the power to impose civil sanctions and to recover testing costs where appropriate.

A requirement of the Regulations is to publish guidance on the use of civil sanctions and the recovery of testing costs (PDF, 569 Kb) .

This document updates guidance first published on 1 April 2011 which only referenced the Ecodesign for Energy Related Products Regulations and the civil sanctions and recovery of testing costs associated with them.

The published guidance also contains an enforcement undertaking form (DOCX, 66 Kb)  which can be downloaded separately.

Prior to publication, the NMO held a consultation exercise which was designed to invite views on NMO's draft guidance. This was not a formal consultation on the legal presentation and drafting of the sanctions but was designed to elicit views on their practical implementation and the procedures associated with their use.

The consultation opened on 15 August 2011 and closed on 12 September 2011.
