Exemptions


There are a number of material exemptions from the RoHS Directive which are listed in annexes of or amendments to the Directive. Exemptions are given for specific technical applications rather than for specific electrical or electronic products.

However, it is the intention that exemptions from the restriction for certain specific materials or components should be limited in their scope and duration, in order to achieve a gradual phase-out of hazardous substances in EEE, given that the use of those substances in such applications should become avoidable.

BIS guidance contains further information for most exemptions, which are listed in Annex 3 (Applications exempted from the restriction in Article 4(1) of the RoHS Directive.

Annex 4 outlines 'Applications exempted from the restriction in Article 4(1) specific to medical devices and monitoring and control instruments' and Annex 5 with 'Applications for granting, renewing and revoking exemptions as referred to in Article 5.'

Article 5  is concerned with the ‘Adaptation of the Annexes to scientific and technical progress’ and outlines the process for granting, renewing or revoking an exemption.
