Improving payment practices in the construction industry

Consultation on amendments to the Scheme for Construction Contracts (England and Wales) Regulations 1998

This consultation paper sets out measures as consequential changes necessary to the Scheme following the changes introduced at part 8 of the Local Democracy Economic Development and Construction Act 2009 (the 2009 Act) to amend the 1996 Act. The deadline for responses to this consultation is Friday 18 June 2010. We would very much welcome your response.

The Local Democracy, Economic Development and Construction (LDEDC) Act 2009

The Local Democracy, Economic Development and Construction Act 2009 received Royal Assent on 12 November. Part 8 of the Act amends the Housing Grants, Construction and Regeneration Act 1996 to improve payment practices and dispute resolution in the construction industry.

Before these amendments can come into force changes will need to be made to the Scheme for Construction Contracts England and Wales 1998 (“the Scheme”). BIS hopes to consult on these changes early in 2010. The Scheme will be subject to the affirmative procedure in Parliament.

The Draft Construction Contracts Bill July 2008 with Explanatory Notes was published in July 2008. Comments were requested by Sept 2008 for technical scrutiny of the draft clauses by industry stakeholders.
