Details of people who have been banned from running an employment agency or business including period of ban

Under section 3(a) of the Employment Agencies Act 1973, the EAS (as part of the Department for Business, Innovation and Skills (BIS)) can apply to an Employment Tribunal to prohibit (ban) someone from running or being involved in running an employment agency or employment business, because of their misconduct or unsuitability.

Once someone has been banned, they cannot run or be involved with running any employment agency or employment business during their prohibition period. The maximum period of any prohibition order is 10 years. Any person who breaches a prohibition order can face criminal proceedings.

They are permitted to run or be involved in running an employment agency or employment business from a separate business address:

The following person is not permitted to run or be involved in running any employment agency or employment business during the period of the prohibition unless Mr Glynn Davies (see list above) is denied access and entry to any premises, including her domestic address, from which the employment agency or employment business trades and she ensures that at all times is prohibited from having any contact with any work-seeker or prospective work-seeker using or considering using the services of the employment agency or employment business.

* Mr Hemming is prohibited from running an employment agency or employment business in respect of actors, musicians, singers, dancers, background artistes, extras, walk-ons, or other performers.  He has to comply with certain conditions agreed with the Department in respect of other work-seekers that he finds work for.
